Tudorel Toader, after the CCR rejected the reform of judges' pensions: "The government can resume the bill"

The former judge of the Constitutional Court, Tudorel Toader, discussed the Government's options after the Constitutional Court rejected the reform of judges' pensions due to the lack of approval from the Superior Council of Magistracy (CSM). Toader explained that the Government can resume the bill, requesting the CSM's approval, which is mandatory but consultative. If it does not receive the approval within 30 days, the project can continue. Toader emphasized that the Government acted incorrectly, lacking the patience to wait for the approval, probably due to the CSM's statement which was against the reform. He also mentioned that, even if the project is resumed, there is a risk that it could be rejected again on the merits, depending on the assessment of the impact on the independence of judges. The current status of judges remains in effect until a new decision.
