The former judge of the Constitutional Court, Tudorel Toader, stated that the reform of special pensions for magistrates could be accepted by the Constitutional Court (CCR), even if the Government maintains the initial form of the law. He emphasized that the proposed changes, such as the pension percentage and retirement age, do not fundamentally change the essence of the issue.
The interim president of the PSD, Sorin Grindeanu, mentioned that the reform has content issues, and Prime Minister Ilie Bolojan intends to take the same law to the CCR. The project provides for a pension of 70% of the net salary and a retirement age of 65 by 2036, while the PSD proposes 75% and a retirement age of 65 by 2041. Toader emphasized that, although the CCR could accept the law, the changes are not decisive and that magistrates will likely contest the project. He added that judges do not rule based on opportunity, but on constitutionality, and that any law has a presumption of constitutionality.
