CCR: The reform of judges' pensions may be constitutional, but the Government has made a mistake in the procedure regarding the CSM's opinion.

The Constitutional Court of Romania published on Friday the reasoning behind the decision regarding the unconstitutionality of the judges' pension reform. The CCR judges indicate that the Government did not fulfill the obligation to appropriately request the opinion of the Superior Council of Magistracy (CSM), emphasizing that the Executive is required to wait for the legal term for issuing this opinion. However, the Court specifies that, under certain conditions, a reform of judges' pensions could be constitutional if the procedures and principles of judicial independence are respected.
