The High Court of Cassation and Justice (ÎCCJ) is expected to announce on Thursday the final decision in the case regarding the payment of outstanding salary rights for magistrates, resulting from retroactively established increases. The court won the case against the Government and the Ministry of Finance in the first instance, and the stakes of this case are approximately 5 billion lei. The Bucharest Court of Appeal has ordered the Government to pay these rights, establishing strict deadlines and penalties for delays.

ÎCCJ argues that non-payment affects the property rights of judges and accuses the Government of violating the separation of powers in the state. The Government has requested the referral to the Constitutional Court to clarify whether the courts can impose additional budget allocations.
