The High Court of Cassation and Justice is expected to deliver its ruling Thursday on the appeal filed by the government and the Ministry of Finance against the Bucharest Court of Appeal’s judgment concerning the payment of magistrates’ outstanding salary entitlements. The ruling has been postponed seven times, while the amount estimated by interim Prime Minister Ilie Bolojan stands at RON 4.8 billion.
On May 5, the Bucharest Court of Appeal ruled that the government and the Ministry of Finance must provide full funding for salary entitlements falling due in 2026, including through a budget revision. The ruling set a 10-day deadline for enforcement from the date it became final, as well as penalties of 1% for each day of delay. The government and the Ministry of Finance appealed the decision.
The case was registered with the Bucharest Court of Appeal on March 30, after the High Court initiated the proceedings following Bolojan’s announcement concerning cuts to expenditures for entitlements secured by magistrates through court rulings.
Meanwhile, the prime minister referred an alleged conflict between the government and the High Court to the Constitutional Court. The Constitutional Court dismissed the request as inadmissible, stating that the mechanism cannot be used as a means of appeal against a court ruling.
