The High Court of Cassation and Justice was due to rule, on several occasions, on the appeal lodged by the Government and the Ministry of Finance against the Bucharest Court of Appeal’s ruling regarding the payment of judges’ outstanding salary entitlements. The ruling was repeatedly postponed, while the financial stakes were presented as approximately 5 billion lei.
In the Bucharest Court of Appeal’s ruling, the Government and the Ministry of Finance were obliged to ensure all the funds necessary for the payments, including through a budget adjustment, with a 10-day deadline for enforcement from the date the ruling became final and penalties for delays. However, the Government challenged the obligation, arguing that the court had exceeded the limits of its powers in budgetary matters.
The dispute was further intensified by the Government’s efforts before the Constitutional Court and the Court of Justice of the European Union, seeking clarification on whether a court may impose additional budget allocations. Meanwhile, the Constitutional Court dismissed as inadmissible a referral concerning an alleged conflict between the Government and the High Court of Cassation and Justice, and the case continued at the appeal stage.
