The Supreme Court of the United States has announced that it will examine the legality of firearm possession by individuals who regularly consume marijuana, a decision that could redefine the right to bear arms in the context of the partial legalization of cannabis in various states. The case was brought before the court by the Trump administration, which requested the dismissal of charges against Ali Danial Hemani, a man from Texas, accused of firearm possession under the conditions in which he acknowledges frequent marijuana use.
The U.S. Court of Appeals for the Fifth Circuit declared that the federal ban is unconstitutional, but the government argues that it is necessary for public safety. Hemani's lawyers argue that the law is too vague and affects millions of Americans, considering that 20% of citizens have consumed cannabis. Although many states have legalized marijuana, it remains illegal at the federal level.
