CCR postponed for November 12 the analysis of the notification from President Nicușor Dan regarding the amendments to the law on cults.

The Constitutional Court of Romania (CCR) decided to postpone the analysis of the complaint made by President Nicușor Dan regarding the amendments to Law no. 489/2006, which regulates religious freedom and worship, to November 12. The President contested the amendments that sanction the exercise of clerical functions without rights, including those of rabbi and imam, considering that the adoption of the law violated constitutional norms.

Nicușor Dan emphasized that the law expands the scope of the offense and allows the State Secretariat for Religious Affairs to define clerical functions through sub-legal acts, which contradicts the principles of legislative clarity. He also criticized the incomplete enumeration of clerical functions, which does not include all specific titles of recognized cults. The law was initiated by Deputy Silviu Vexler and was adopted by Parliament on June 28. The President believes that the amendments violate religious freedom and the right to expression, requesting a review of the normative content.
