President Nicușor Dan has notified the Constitutional Court regarding the amendments made to the Law on Electricity and Natural Gas no. 123/2012, stating that the law was adopted in violation of the limits of re-examination. The law was initially sent for promulgation on November 25, 2023, and Dan requested its re-examination on December 12, asking for an assessment of the normative solutions in relation to European legislation and the balance between the rights of prosumers and energy suppliers.
In his notification, Dan emphasizes that Parliament has exceeded the limits of re-examination by adopting new regulations that were not included in the re-examination request. According to the Constitution, the President can request a single re-examination, and subsequent amendments must respect the initial objections. Dan thus requests the declaration of the unconstitutionality of the law, also invoking the jurisprudence of the Constitutional Court which supports that re-examination must be limited to the objections raised by the President.
