President Nicușor Dan has sent the Constitutional Court (CCR) a notification of unconstitutionality regarding the Law for amending the Government Emergency Ordinance on the decarbonization of the energy sector.
The law, adopted by Parliament on August 7, modifies the mechanisms for withdrawing energy capacities based on lignite and coal, conditioning the decommissioning on the installation of low-carbon emission capacities.
Nicușor Dan argues that this law affects Romania's fulfillment of its obligations under the Recovery and Resilience Mechanism, as well as environmental protection, by substantially altering the legal framework for decarbonization. The criticisms focus on compatibility with European obligations and the clarity requirements of the law, as well as the risks of making measures to reduce environmental impact ineffective.
The president emphasizes that the withdrawal of polluting capacities is essential for reducing negative environmental effects, and the conditions introduced by the law could contravene the Constitution.
