President Nicușor Dan has sent the Constitutional Court a notification of unconstitutionality regarding the Law that approves Government Ordinance no. 36/2024, which concerns the authorization of constructions for national transport infrastructure and the metro. Nicușor Dan argues that the amendments made by the normative act allow the registration of property rights over constructions in the land registry without requiring a construction certification, which could compromise the technical control necessary for public safety. He emphasizes that the elimination of the verification procedure may lead to risks for the life and integrity of users. Additionally, Nicușor Dan believes that the law has a discriminatory character, favoring a specific entity, Metrorex, to the detriment of other legal subjects that carry out similar projects. This regulation, having an individual character, contravenes the principle of separation of powers in the state and equality in rights, which makes it unconstitutional as a whole, the Presidency of Romania assesses.
