Nicușor Dan has promulgated the law eliminating the risk of incompatibility for local and county councilors

President Nicușor Dan promulgated on Wednesday the law repealing provisions of the Administrative Code that could have created incompatibilities for local and county councilors who also hold certain positions in public administration. The amendment aims to prevent the loss of mandates and disruptions to the activity of public institutions.

Parliament quickly adopted the bill on August 26, after Law No. 165/2026, which entered into force on August 9, introduced restrictions on combining employment at certain public institutions with a mandate as a local or county councilor.

The new law repeals paragraphs (2)-(6) of Article 550 of the Administrative Code. These provisions regulated cases of conflicts of interest and incompatibility involving contract-based staff, as well as the applicable sanctions.

The legislation also provides that situations arising between the entry into force of Law No. 165/2026 and the entry into force of the new law will not be considered incompatibilities or conflicts of interest and will not entail legal liability.

The amendments were supported after several local elected officials raised concerns that they could lose their mandates if they did not relinquish positions held in public administration. Councilors in Arad were among those who announced their resignations because of the legislative uncertainty.
