President Nicușor Dan sent the Parliament the request for re-examination of the law that amends OUG 31/2002 regarding the fight against extremism, arguing that it could affect freedom of expression and could lead to abuses.
Dan emphasizes that the law does not clearly define the offenses, allowing for abusive interpretations, such as punishing the distribution of xenophobic materials without distinction between extremist propaganda and literary works.
Although the Constitutional Court rejected his complaint, considering the law clear and well-defined, Dan warns that an unbalanced application of the law could amplify social tensions and distrust in institutions. He criticizes the absence of legal definitions for the terms "legionary" and "fascist," which could lead to legal instability.
Thus, the president of the state argues that, in order to protect democracy, the state must act firmly, but also with balance, respecting fundamental rights.
