President Nicușor Dan commented on the decision of the Court of Justice of the European Union (CJEU), emphasizing that the main blame for the current situation lies with Parliament, which has not made the necessary legislative correction following a decision of the Constitutional Court. Dan mentioned that, according to the Constitution, this correction should have been made within a period of 45 days, but it has not happened for many years.

He explained that the law is not an exact science and that the act of justice involves balancing legal principles. The CJEU recently clarified that the interpretation given by the High Court of Cassation and Justice of Romania regarding the statute of limitations for criminal liability is not compatible with European Union legislation in cases of serious fraud. This decision has significant implications for ongoing criminal cases.
