President Nicușor Dan sent, on Tuesday, a notification to the Constitutional Court of Romania, challenging the constitutionality of the Law that amends the Government's Emergency Ordinance regarding the use of the beaches of the Black Sea. The law allows the property owner, the state, to grant local authorities a share of up to 20% of the beaches used for tourism purposes free of charge.
Nicușor Dan argues that local authorities do not have the capacity to receive these beaches, as they are not public utility institutions, contrary to constitutional provisions. Thus, he claims that the legislative solution contravenes Article 136 paragraph 4 of the Constitution, which regulates the public domain of the state.
