The Senate has adopted a legislative proposal for regulating the use of audio-video cameras by local police officers, providing a clear legal framework.

On November 19, the Senate adopted a legislative proposal that regulates the use of portable audio-video cameras by local police officers. Although the project is not yet law, it could introduce clear rules regarding the filming of interventions, the processing of personal data, and the retention of recordings. Currently, local police officers do not have a legal framework to use body cameras, which has led to the blocking of their use and the deletion of recordings by the courts.

The project establishes that body cameras must be activated in certain situations, such as legitimizing a person or interventions that may affect public order, without requiring the consent of the filmed person. Police officers must inform the public about the use of these devices. Recordings will be retained for a maximum of six months, except in cases where they become legal evidence.

Each local police department will have a data protection officer, and police officers will receive regular training to prevent abuses. Violating the rules will result in disciplinary or criminal sanctions. The project could transform the way local police interact with citizens, providing additional protection for officers and a guarantee for citizens that interactions are properly documented. The vote of the Chamber of Deputies is next to complete the legislative process.
