The Constitutional Court of Romania (CCR) decided to postpone the analysis of the complaint filed by President Nicușor Dan regarding the amendments to the Law on Electricity and Natural Gas until February 4. This law, sent back to Parliament in December 2023, was contested by the president, who argues that the amendments exceed the limits of the initial review requested. Nicușor Dan argued that Parliament introduced new legislative solutions that were not included in the previous version of the law.
Among the contested aspects are the restrictive conditions for prosumers, such as the requirement that delivery and consumption points be connected to the same distribution operator, and the exemption of prosumers with installed power below 900 kW from paying imbalances. Additionally, the president emphasized that the changes made by Parliament are not just technical correlations, but represent different public policy options. The law was initially sent for promulgation on November 25, 2023, having significant amendments for prosumers, and the CCR's decision will clarify the constitutionality of these amendments.
