In the context of the current political crisis, Augustin Zegrean, former president of the Constitutional Court, criticized Nicușor Dan's refusal to appoint a prime minister, considering that he does not respect constitutional provisions. Zegrean explained that, according to the Constitution, the president has the obligation to appoint a prime minister, and the 10-day deadline for forming a parliamentary majority is clearly established. He emphasized that, in the event that the designated prime minister fails to present themselves in Parliament within this period, it is considered that they have resigned their mandate.

Although Zegrean stated that Nicușor Dan's attitude is unconstitutional, he does not see the suspension of the president as a viable solution, considering the previous suspension experiences that were not well received by the population. Zegrean mentioned that Parliament has tools to act against the president, but he emphasized that Romanians expect those elected to lead without constantly seeking the opinion of citizens.

"The president is the one who must appoint. In the Constitution, the deadlines for such situations are very short. The person designated to form the Government has 10 days at their disposal, after which, if they do not present themselves in Parliament, it is considered that they have resigned their mandate, as some like to say.

The president must force the formation of the government and the deadline for dissolving Parliament is very short. If within 60 days Parliament does not approve any of the proposals made by the president, he can dissolve Parliament. Since the moment the country has remained without a government and until today, the president is the one who must take the initiative," Zegrean stated.
