The Court of Justice of the European Union (CJEU) has established that pets can be considered 'luggage' in the context of air transport, which affects the rights of owners in case of loss. The decision was made following a complaint from a passenger who lost her dog at Buenos Aires airport in 2019. Although Iberia Airlines acknowledged the loss, it claimed that its liability is limited according to European regulations.
The CJEU concluded that, based on the Montreal Convention of 1999, animals transported in the hold of the aircraft are included in the category of goods, and airlines are not obliged to pay compensation greater than that established, unless the owners declare a 'special interest' in the transported animal. This ruling provides legal clarity for airlines and limits financial claims in the event of the loss of pets.
