The Constitutional Court (CCR) will debate on June 10 the request of the President of the Chamber of Deputies, Sorin Grindeanu, to resolve a legal conflict of a constitutional nature between Parliament and the Government, regarding the SAFE Ordinance. On June 4, the CCR will also analyze the referral from the Ombudsman related to the same ordinance. Grindeanu argues that the Government's Emergency Ordinance no. 38/2026 was adopted beyond the constitutional competences of a dismissed Government, which makes it incompatible with the Constitution. He argues that the 11 amendments introduced render the ordinance unconstitutional. Additionally, the Ombudsman has submitted a plea of unconstitutionality, invoking the violation of the obligation to request the opinion of the Legislative Council and the prohibition of issuing ordinances by a dismissed Government. This situation highlights the tensions between the branches of government in the current legislative context.
