The Constitutional Court of Romania has decided to postpone, for the second time, the debates in the case of the referral by the President of the Chamber of Deputies, Sorin Grindeanu, regarding a possible legal conflict of constitutional nature between the Government and Parliament, generated by the issuance of Emergency Ordinance no. 38/2026.

Grindeanu argues that the Government acted unconstitutionally by adopting and publishing this ordinance after the Parliament withdrew its confidence through a motion of censure, which transformed the Government into a competing legislative authority with Parliament. The referral mentions that the Government substantially expanded the draft ordinance on the day of the vote on the motion of censure, thus affecting the legislative process and the constitutional balance between the powers of the state. Grindeanu requests the Court to decide on the necessary leadership to restore constitutional order.
