The Constitutional Court of Romania is set to rule on Thursday, October 22, on the referral submitted by the President of the Chamber of Deputies, Sorin Grindeanu, concerning the existence of a legal conflict of a constitutional nature between Parliament and the Government. The referral concerns Emergency Ordinance No. 38/2026, relating to the SAFE program, adopted and sent for publication by the Bolojan Cabinet after the Government was dismissed through a vote of no confidence.
Grindeanu argues that the Executive no longer had the right to adopt normative acts with the force of law after Parliament withdrew its confidence on May 5, 2026. Emergency Ordinance 38/2026 was published in the Official Gazette on May 8, during the period when the Government could exercise only acts of current administration of public affairs.
The President of the Chamber of Deputies also complains that the ordinance regulated areas already under parliamentary procedure, affecting Parliament’s role as the sole legislative authority and generating legal uncertainty.
Grindeanu asks the CCR to find that the constitutional powers of the dismissed Government were exceeded and to establish the Executive’s obligation to no longer issue normative acts with the force of primary law.
