The Constitutional Court of Romania has postponed until October 7 the debate on the petition filed by the president of the Chamber of Deputies, Sorin Grindeanu, concerning a possible legal conflict of a constitutional nature between the Government and Parliament, generated by the adoption of the emergency ordinance concerning the SAFE Programme.
Sorin Grindeanu is asking the Constitutional Court to establish that the conflict exists and to determine the measures necessary to restore the constitutional order. In the petition, he argues that the Government adopted and sent for publication Emergency Ordinance No. 38/2026 after Parliament withdrew its confidence through a motion of no confidence, voted on May 5, 2026. The normative act was published in the Official Gazette on May 8.
The president of the Chamber of Deputies claims that the Executive, being in the situation provided for by Article 110(4) of the Constitution, could only ensure the routine administration of public affairs and no longer had the right to legislate through emergency ordinances.
The petition also states that the ordinance regulated areas already subject to parliamentary procedure. The bill was allegedly expanded on the morning of May 5 by adding 12 articles, before the vote on the motion of no confidence. Grindeanu argues that this conduct diminished Parliament’s role and affected the balance between the powers of the state.
