The Constitutional Court of Romania (CCR) decided on Thursday to postpone the ruling on the referral from the President of the Chamber of Deputies, Sorin Grindeanu, regarding a possible legal conflict of constitutional nature between Parliament and the Bolojan Government concerning the emergency ordinance regarding the SAFE program.
Grindeanu argues that the Government adopted Emergency Ordinance no. 38/2026 after Parliament withdrew its confidence from Ilie Bolojan through a motion of censure, which would have limited the Executive's competencies to current administrative acts.
The referral emphasizes that the Government published the ordinance in the Official Gazette, contrary to constitutional provisions, and substantially extended the initial project on the day of the vote on the motion of censure.
Grindeanu argues that this action affects the constitutional balance between the powers of the state and undermines the deliberative role of Parliament, which is the sole legislative authority of the country.
A similar referral, rejected by the CCR, was also made by AUR, SOS Romania, and PACE.
