The spokesperson of the High Court of Cassation and Justice, Victor Alistar, stated that the law regarding the retirement of judges discriminates against this category compared to other groups benefiting from service pensions and violates the independence of justice. Alistar explained that the draft law effectively eliminates the service pension for judges and contravenes the international standards established by the Court of Justice of the European Union. He also emphasized that the law uses ambiguous terms and creates uncertainty, affecting the security of legal relations.
Alistar mentioned that 66% of judges will experience a sudden increase in the retirement age, and the law creates an evident discrimination between categories of service pensions, being clearly unfavorable to judges. Following these findings, the United Sections of the High Court of Cassation and Justice decided, with unanimous votes, to refer the law to the Constitutional Court regarding its unconstitutionality.
