The judges of the High Court of Cassation and Justice have unanimously decided to refer to the Constitutional Court (CCR) regarding a new draft law that modifies the retirement conditions for magistrates. This is the second time such a draft is contested, the first being declared unconstitutional because the Bolojan Government did not wait for the opinion of the Superior Council of Magistracy (CSM).
Prime Minister Bolojan has assumed responsibility for this project, which provides for a 15-year transition period for the retirement of magistrates, instead of 10 years, as was in the first version. The pension will be 70% of the last net salary, and the retirement age will increase annually, reaching 65 years in 2042. Additionally, magistrates can retire early, but with penalties if they are not 65 years old. The CSM gave a negative opinion on the new law, which will be subject to a motion of censure from the opposition.
