The Iași County Police Inspectorate and the National Agency for Fiscal Administration are in a legal dispute over 4,807 lei, the value of 437 chicks confiscated in 2020 from a street trader in the commune of Țigănași.
The chicks, sold for 11 lei each, were seized by police officers in May 2020. The trader challenged the sanction, and the court established that he possessed all the necessary documents: an authorized sole proprietorship, veterinary health certificates, and documents for transporting and selling live birds. The District Court annulled the report and ordered the return of the chicks or payment of their value. The decision became final after the appeal filed by the County Police Inspectorate.
In the meantime, the birds had been handed over to an economic operator and sold for the benefit of the state budget. Following enforcement proceedings, the police paid 7,792 lei: the value of the chicks, legal costs, and enforcement expenses.
The County Police Inspectorate asked ANAF to reimburse the 4,807 lei, but the request was rejected in November 2023. The tax authority argued that the money could be reimbursed only to the person from whom the goods had been confiscated, not to a public institution. The District Court dismissed the police’s action, and the County Police Inspectorate appealed to the Tribunal.
