ANAF stated on Wednesday evening that the recovery of budgetary claims is carried out in accordance with the law, uniformly and without discrimination, regardless of whether the debtor is an individual, a company, or a political party. The clarifications come after the Permanent Electoral Authority announced that the PNL must repay more than 14 million lei and that it had notified the Tax Authority to recover the amount.
The National Liberal Party lost its case against the AEP definitively at the High Court of Cassation and Justice and is required to pay 14,117,378.04 lei. The money was used to promote the book of former Liberal leader Nicolae Ciucă. AEP President Adrian Țuțuianu stated that the institution had been unable to begin enforcement proceedings and that it notified ANAF after the final ruling was handed down.
The Tax Authority emphasizes that forced enforcement is not the only recovery mechanism. The procedure begins with establishing the arrears and the possibility of voluntary payment or set-off. Subsequently, the debtor is served with a payment notice and has 15 days to pay the debt or initiate mediation. If the obligations are not settled, garnishments may be imposed on accounts and amounts owed by third parties, as well as seizures and sales of assets.
ANAF also points out that debtors may request payment by installments. If approved, forced enforcement for the amounts included in the installment plan is suspended, under the conditions set out by law. PNL President Ilie Bolojan stated that the party would pay the amount owed.
