Călin Georgescu's lawyers have submitted a request to the Bucharest Court of Appeal for the return of the indictment to the Prosecutor's Office next to the High Court of Cassation and Justice, citing possible irregularities in the process of confirming the indictment. They argue that prosecutor Remus Popa, who confirmed the indictment, also carried out criminal investigation acts in Georgescu's case, which is against the law, as a prosecutor cannot review their own activity. Additionally, the defenders contest the authenticity of Popa's signature on the indictment, mentioning a handwritten "p" next to the signature, suggesting that someone else may have signed in his place.
Citing Article 328 of the Criminal Procedure Code, the lawyers argue that the indictment was not verified by a superior prosecutor, thus affecting the impartiality of the procedure and the procedural rights of the defendant. They request that the Prosecutor's Office remedy the irregularities within five days, otherwise to order the return of the case file. The case is in the preliminary chamber phase, judged by magistrate Mihai-Paul Cozma. Călin Georgescu is accused of communicating false information and aiding the perpetrator.
