The Constitutional Court of Romania (CCR) will debate on Wednesday the referral of President Nicușor Dan regarding the unconstitutionality of the law regulating the use of the beaches of the Black Sea.

The referral, sent to the CCR last November, challenges the amendments made to the Government Emergency Ordinance no. 19/2006, which allows the state to grant up to 20% of the beaches used for tourism free of charge to local authorities. Nicușor Dan argues that this measure violates constitutional provisions, as the beaches are public property of the state, and local authorities cannot benefit from such a free allocation. He emphasizes that, according to the Constitution, only certain public utility institutions can receive goods from the public domain, and the proposed allocation contravenes Article 136 paragraph (4) of the Constitution.
