Nicușor Dan has notified the Constitutional Court of Romania (CCR) regarding a law recently adopted by Parliament, which allows for the extension of subsidies for apartment heating systems by two years. This measure contravenes European norms that prohibit such subsidies starting in 2025. Dan argues that national legislation cannot contradict European directives, invoking Article 148 of the Constitution, which mandates compliance with community regulations. The law adopted by Parliament introduces an exception that allows local authorities to grant financial incentives for properties connected to heating points with fewer than 50 users, arguing that this is necessary to protect local budgets.

Nicușor Dan warns that the adoption of this law could attract financial penalties and affect the right to a healthy environment, guaranteed by the Constitution. Additionally, Romania is facing an infringement procedure due to delays in adopting environmental legislation, and the enactment of this law could lead to the loss of European funds for the modernization of heating systems.
