The General Court of Luxembourg ruled in favor of the companies Meta and TikTok, challenging the methodology by which the European Union calculated the 0.05% supervisory tax on global annual net revenue. This tax, intended for monitoring compliance with the Digital Services Act, was deemed disproportionate in relation to the number of active users. The EU now has one year to establish a new calculation methodology, but Meta and TikTok will not receive refunds for the taxes paid in 2023.
