The constitutional judge Gheorghe Stan is on leave and will not participate in the meeting of the Constitutional Court (CCR) scheduled for Wednesday, February 11, when the reform of judges' pensions was supposed to be discussed. This absence is expected to lead to another postponement of the decision, considering that the CCR regulations stipulate that no decisions can be made without the presence of all judges involved in the debates.

The CCR's decision on the reform of judges' pensions has been postponed four times

Stan, one of the four judges proposed by PSD, has previously boycotted meetings on this topic, and the pension reform has already been postponed four times, the last time on January 16.

The law has been challenged by the High Court of Cassation and Justice, and this latest postponement was justified by the need for a more detailed study of the issues related to the case and the extrajudicial accounting expertise submitted by the High Court of Cassation and Justice on January 15, 2026.

Stan's potential absence is preceded by a series of departures or boycotts by other judges during the debates. They argued that their absence did not block the CCR's activity, but was a decision to respect the rules.

The final decision on this reform remains uncertain, awaiting the presence of all judges, while Prime Minister Ilie Bolojan sent a letter to the CCR in which he urges the judges to expedite the decision regarding special pensions. According to him, the postponement of the decision would lead to a loss of 230 million euros from the PNRR
