The Bucharest Court of Appeal (CAB) will hear on Monday, September 28, the request by the Association of Italians in Romania (RO.AS.IT) to annul the decree by which President Nicușor Dan designated Siegfried Mureșan as a candidate for the position of prime minister. The case was registered on September 22, with the Ninth Administrative and Fiscal Litigation Division.
RO.AS.IT is requesting the annulment of Presidential Decree No. 770/2026, by which Mureșan was designated to ask Parliament for a vote of confidence in the program and list of the new Government. In the case, the defendants are the Presidential Administration and the Autonomous Administration Official Gazette.
Former judge Cristi Dănileț argued that presidential decrees issued as acts of authority cannot be challenged in ordinary courts, as they represent acts of a constitutional authority.
RO.AS.IT's initiative was indirectly criticized by 11 organizations of the Italian community in Romania. They stated that they did not intend to intervene in domestic politics and described the designation of the prime minister as a constitutional and institutional procedure.
The association is led by unaffiliated MP Ioana Grosaru and receives public funding. RO.AS.IT previously challenged, before the same court, the decrees appointing the heads of the DNA, the General Prosecutor's Office, and DIICOT. The ruling in that case was postponed until September 28.
