The Constitutional Court of Romania has postponed the decision regarding the reform of judges' pensions to December 29, 2025, after the High Court of Cassation and Justice referred the new project of the Bolojan Government to the CCR.

The judges of the Constitutional Court of Romania (CCR) have once again postponed the decision regarding the reform of special pensions for magistrates, scheduled for December 28, 2025. This was requested by the High Court of Cassation and Justice (ICCJ), which unanimously voted to refer the matter to the CCR, considering that the new project of the Bolojan Government discriminates against magistrates and undermines the independence of the judiciary.


The ICCJ emphasized that the law would practically annul the service pensions for magistrates and create a disadvantageous legal regime compared to other professional categories. Additionally, the project lacks a clear financial justification. The government proposes raising the retirement age to 65 and limiting the pension to 70% of the net allowance, which has been contested by judges. The CCR previously declared a similar project unconstitutional, citing the lack of approval from the Superior Council of Magistracy.
