The Constitutional Court has decided that the automatic cessation of the activity of judicial police officers after the withdrawal of the opinion of the chief prosecutor of DIICOT is unconstitutional.

The Constitutional Court of Romania ruled on Wednesday that the legal provisions that automatically lead to the cessation of the activity of judicial police officers or agents from the structures combating organized crime, after the withdrawal of the opinion of the chief prosecutor of DIICOT, do not comply with the Constitution. The judges of the CCR unanimously accepted the exception of unconstitutionality, emphasizing that these provisions are constitutional only if the withdrawal of the opinion is made according to the established legal procedures. The Court highlighted that the criticized text does not provide a clear and predictable framework for the conditions and procedure for the cessation of the activity of judicial police officers, thus violating the principle of legality. Additionally, the CCR emphasized that the status of the judicial police officer cannot be subject to derogations that ignore the already established constitutional requirements.
