Cartel Alfa requests the Ombudsman to challenge at the Constitutional Court the ordinance that provides for the non-payment of the first day of medical leave, considering it unconstitutional.

The National Trade Union Confederation Cartel Alfa has requested the Ombudsman to notify the Constitutional Court regarding an emergency ordinance that introduces an unpaid medical leave day between February 1, 2026, and December 31, 2027. The trade unionists argue that the right to social protection in case of illness cannot be conditioned or reduced, emphasizing that the normative act affects health insurance benefits, regardless of medical reasons or contribution period.

Cartel Alfa states that any reform of the social insurance system must be carried out through social dialogue and respect for the Constitution. The Minister of Health, Alexandru Rogobete, acknowledged that the measure may create inequalities but was justified by the need to control fictitious medical leaves.
