The President of the National Council of the PSD, Mihai Tudose, emphasized on Facebook that, according to the law, the interim period of a minister cannot exceed 45 days.
He compares the situation to a transport subscription, which becomes invalid after this period. Tudose states that interim ministers and state secretaries from the ministries led by them no longer have legal competence, which makes the acts signed by them null and void.
He also mentions the case of the interim Minister of Energy, Bolojan Ilie, who allegedly signed acts without having the legal right. The PSD has challenged in court several government decisions issued by the interim Government and has obtained some victories.
The Constitution clearly states that the interim cannot exceed 45 days, but the former president of the Constitutional Court, Augustin Zegrean, argues that a dismissed government can remain in office until the investiture of a new executive.
