The European Commission has opened infringement procedures against Romania and Portugal by sending letters of formal notice, after the two countries failed to submit the overdue report by June 1, 2025, under the EU regulation on invasive alien species.

The European executive indicates that Regulation (EU) 1143/2014 establishes measures at the level of the entire Union aimed at preventing, minimizing, and mitigating the negative effects of invasive alien species on biodiversity and ecosystem services, as well as related impacts on human health and the economy.
In this context, member states must update and submit to the Commission, every six years, information regarding national monitoring and official control systems, the distribution of invasive alien species of Union interest, action plans targeting priority pathways of introduction and spread, as well as aggregated information on eradication and management measures, among other elements.
The Commission states that these reports provide a clear picture of how the regulation is implemented and any difficulties encountered by member states, contributing to environmental protection, health, and economic objectives. Until now, Romania and Portugal have not submitted the required report, which is why Brussels has sent letters of formal notice to both countries.
According to the Commission's explanations regarding the application of EU law, the letter of formal notice represents the first formal step in the infringement procedure and is followed, if the state's response is unsatisfactory, by a reasoned opinion. If the state continues to fail to comply, the Commission may decide to refer the case to the Court of Justice of the European Union.
