On November 6, 2025, the High Court of Cassation and Justice pronounced the final verdict in the case between the Romanian state, represented by the Ministry of Public Finance, and Gabriel Resources (Jersey) Limited. The case concerned the recovery of expenses of 46,779,769 lei incurred by the state in the context of the international arbitration related to the mining project at Roșia Montană. The court decided that the actions of Gabriel Resources should be placed under precautionary seizure, thus ensuring the recovery of the debts owed to the state. This measure confirms the legality of the previous decision of the National Agency for Fiscal Administration, contested by the company.
In the event that Gabriel Resources does not pay the amount established within the deadlines set by law, the seized actions may be subject to forced execution. The decision of the ICCJ comes in the context in which Romania has won the case in international arbitration against the company, marking a significant moment in a complex litigation that has lasted nearly two decades.
