Huawei has notified the Constitutional Court of Romania to contest the legality of its exclusion from 5G networks, a decision based on the 5G Law.

The Chinese giant Huawei has obtained the referral of the Constitutional Court (CCR) regarding the possible unconstitutionality of the law that led to the rejection of its request for authorization to use 5G equipment in Romania.

The Bucharest Court of Appeal decided on April 7, 2026, to send the case to the CCR, which will analyze Law 163/2021, which regulates communication infrastructures. In February 2024, the CSAT prohibited the use of Huawei equipment, citing risks to national security.

Huawei contested this decision, stating that an objective assessment had not been carried out. The 5G law, adopted following the Memorandum with the USA, aims to limit security risks from Chinese manufacturers, and equipment that does not obtain CSAT approval can only be used temporarily. The European Commission supported the exclusion of Huawei and ZTE equipment from 5G networks, citing security risks.
