The Federation of Cancer Patients' Associations (FABC) has sent an open letter to the Ombudsman, Renate Weber, requesting her intervention regarding Government Emergency Ordinance no. 91/2025, which comes into force on February 1, 2026. The measure stipulates that the first day of medical leave will not be paid, particularly affecting chronic patients who must frequently be absent from work for treatments. FABC argues that this measure, adopted without adequate justification, generates disproportionate and inequitable effects, penalizing patients who choose to remain professionally active.


The Federation emphasizes that the non-payment of the first day of medical leave affects the right to health and contravenes the principle of contribution in the social insurance system. FABC calls for an analysis of the constitutionality of the measure and the formulation of recommendations for its correction, warning that, in the absence of a prompt response, it will appeal to European courts. The president of FABC, Cezar Irimia, states that a fair health system should not penalize patients who work despite their illness.
