The Bucharest Court of Appeal rejected the request of AUR lawyer, Silvia Uscov, to annul the Senate's decision regarding the appointment of Mihai Busuioc to the Constitutional Court.

The Bucharest Court of Appeal decided on Wednesday to reject the request of AUR lawyer, Silvia Uscov, who sought the annulment of the Senate's decision from June 2025 by which Mihai Busuioc was appointed judge at the Constitutional Court. The court established that the annulment of a Senate decision is not within the jurisdiction of the courts, declaring the request inadmissible. At the same time, the CAB accepted Mihai Busuioc's request to refer to the Constitutional Court a plea of unconstitutionality regarding certain articles of Law no. 554/2004, which regulates the challenge of administrative acts. In parallel, Silvia Uscov has opened a new lawsuit for the annulment of the appointment of CCR judge Dacian Dragoș, with a hearing set for May 5.

Uscov argues that both Busuioc and Dragoș do not meet the legal requirements to hold positions at the CCR, considering the requirement of 18 years of legal experience. These actions are part of a strategy to block the CCR's decisions related to the reform of special pensions for magistrates, although the CCR recently declared that the law is constitutional.
