The Superior Council of Magistracy (CSM) expressed its viewpoint on the draft law regarding salary in the public sector, emphasizing that it presents constitutional flaws.


CSM contests the manner in which the draft was promoted, invoking Article 110 paragraph 4 of the Constitution, which prohibits a dismissed government from initiating legislative projects. Additionally, CSM requests that the salaries of judges and prosecutors be regulated by a special law, according to Article 205 of the Statute of Judges and Prosecutors.


The criticisms focus on the inclusion of magistrates in the common salary grid of the budgetary sector, which affects their salary rights. CSM emphasizes that the salaries of magistrates should not be lower than those of parliamentarians or ministers and contests the elimination of bonuses, considering that they are essential for the specific working conditions.


In conclusion, CSM requests an adequate and fair regulation for the salaries of magistrates that respects the independence of justice.
