On Wednesday, the Superior Council of Magistracy published data on judges’ allowances in Romania, amid debate triggered by a recent decision of the European Court of Human Rights. The CSM maintains that magistrates’ incomes must be assessed in relation to the national average salary and comparable European data.

According to the salary scales for October, monthly net allowances range from 6,990 to 8,285 lei for trainee judges, from 10,486 to 16,157 lei for judges at court of first instance level, from 14,390 to 17,948 lei for those at tribunal level, and from 16,309 to 20,346 lei for judges at court of appeal level. The sums include bonuses and vary depending on seniority and salary grade.

The CSM data covers 4,544 judges: 46% work at courts of first instance, 33% at tribunals, and 21% at courts of appeal. Compared with the national average gross salary of 9,497 lei, the minimum gross allowance of a trainee judge amounts to 1.26 average salaries, while that of a fully qualified judge at court of first instance level amounts to 1.89.

The European average calculated on the basis of CEPEJ data is approximately 2.13 national average gross salaries. The CSM notes that, in an analysis published in 2025, Romania ranked 20th out of 27 EU member states for gross income at the start of a career and 22nd for net income.

The reaction comes after the ECHR rejected applications filed by five Romanian judges and former judges concerning the payment of salary compensation. The CSM warns that the distorted presentation of domestic realities before international jurisdictions may affect the credibility of institutions and of Romania.

Context: The ECHR had previously rejected judges’ complaints regarding staggered payment, while salary disputes continue domestically

Before the publication of the CSM data, the European Court of Human Rights declared inadmissible the complaints lodged by five Romanian judges and former judges concerning the delayed and staggered payment of salary arrears established by court judgments. The ECHR held that a lack of funds does not, in principle, justify non-enforcement of judgments, but considered that, in the circumstances examined, the authorities had adopted successive measures for gradual payment due to economic and fiscal constraints, without affecting the essence of the applicants’ right.

Separately, against the backdrop of the same category of disputes, the High Court of Cassation and Justice postponed several times the delivery of its decision in the case against the Government and the Ministry of Finance concerning the payment of judges’ salary arrears, with approximately 5 billion lei at stake. Requests were also made in the case for referral to the Constitutional Court and the CJEU, while the Bucharest Court of Appeal had previously ordered enforcement of the decision, with penalties for delay.
