The Alliance for the Union of Romanians (AUR) announced that the Ombudsman has referred to the Constitutional Court regarding Emergency Ordinance no. 38/2026, published on May 8, 2026. AUR claims that this referral confirms the illegalities committed by the government led by Ilie Bolojan, which attempted to impose decisions through political pressure.
AUR previously referred to the Ombudsman, arguing that Emergency Ordinance 38/2026, signed by a dismissed government, is unconstitutional, according to articles in the Constitution that prohibit dismissed governments from issuing ordinances. AUR states that the ordinance introduces a mechanism of "unprecedented expropriation," affecting "fundamental rights such as the right to property, the right to work, contractual freedom, and the prohibition of forced labor."
Additionally, today, Senator Radu Oprea stated that the dismissed government led by Ilie Bolojan would have illegally acquired by transmitting to the Official Gazette an Emergency Ordinance regarding investments in the defense industry, after the adoption of the censure motion.
