The Supreme Administrative Court of Poland has ruled that the Polish state must recognize same-sex marriages concluded in other countries within the European Union. This decision was made after the authorities in Warsaw rejected the request of two Polish citizens, Jakub Cupriak-Trojan and Mateusz Trojan, who were married in Berlin in 2018, to have their civil status recognized.
Judge Leszek Kirnaszek emphasized that the Polish Constitution does not prohibit the recognition of marriages from other EU member states. The decision comes after a ruling from the Court of Justice of the European Union, which stated that all marriages concluded in the EU must be recognized.
Although the decision was met with applause, lawyers are unsure whether it applies to all same-sex couples married abroad. In Poland, only 31% of citizens support the legalization of same-sex marriages, but 62% are in favor of the legal recognition of unions between same-sex individuals.
