Meta introduced the 'pay or accept' model in November 2023, but has been in breach of the Digital Markets Act (DMA) for a year. The recent changes, designed to reduce the use of personal data for advertising, do not comply with legal requirements. The European Commission is considering whether the changes are sufficient and warns that continued non-compliance could lead to penalties of up to 5% of turnover. Meta is challenging the rules, arguing that the chosen model is legitimate.
