The High Court of Cassation and Justice (ICCJ) has issued an important clarification regarding the protection of employees on medical leave. Through a recourse in the interest of the law, the ICCJ emphasized that protection against dismissal applies depending on the moment when the dismissal decision is made.

This means that if an employee is on medical leave, their dismissal can only occur under certain conditions, and the timing of the decision is essential to determine its legality. This clarification aims to protect the rights of employees and ensure compliance with labor legislation in such situations.
