The British lawyers of brothers Andrew and Tristan Tate are preparing legal action against the procedure through which the United Kingdom is attempting to secure the extradition of the two from the United States. The defense maintains that the Tate brothers should first answer before the judicial authorities in Romania, where criminal proceedings are still ongoing.

Lawyers Andrew Ford and Adam Rasul, from the firm Holborn Adams, have initiated steps for a “judicial review” procedure, through which a court can examine the legality of a decision made by a public authority, according to The Standard. They argue that direct extradition from the US to the United Kingdom would affect their clients’ ability to prepare their defense in the Romanian cases.

In March 2024, a Romanian court approved the handover of the Tate brothers to the United Kingdom, but only after the completion of the judicial proceedings in Romania. Andrew Tate and Tristan Tate are in custody in Miami after British authorities requested their extradition on charges including rape and facilitating trafficking for the purpose of sexual exploitation. The two deny the allegations.

A federal court in Miami recently rejected their request for release, citing a significant flight risk. Meanwhile, Romania recently indicted Andrew and Tristan Tate for complicity in child trafficking and money laundering. The US Department of State is examining the British request under the extradition treaty between the two countries, and the final decision may be reviewed by the American courts.
